A criminal contempt of court plea was filed by Mahendra Singh Dhoni before the Madras High Court. The plea was against an Indian Police Officer (IPS) G Sampath Kumar for the allegation of putting out remarks against the Supreme Court with regards to the betting case in the Indian T20 League.
A compensation of 100 Crore INR was demanded by the former Indian Cricketer. The case was scheduled to be heard on Friday, but it could not be done, and it was postponed to Tuesday. Kumar had investigated the 2013 Indian T20 League spot-fixing and betting cases. The top court had restrained Kumar from making any remarks against MS Dhoni.
However, an affidavit was filed allegedly by the officer, before the top court which contained derogatory remarks against the judiciary and the Madras High Court. In his affidavit, Dhoni had filed a defamation suit against Kumar.
"The statements of the third respondent are scandalous and are capable of shaking the faith of the common man in the justice system," the plea stated, adding that it constitutes an "act of criminal contempt".
This is in relation to the spot-fixing case in 2013
"I submit that the statements of the Respondent/3rd Defendant made by him in his additional written statement lowers the authority of the Court and also has the effect of interfering and obstructing the administration of justice," the plea added.
The plea went to say that Kumar had put this acquisition on the top court ‘off meandering from its focus on ‘rule of law’ and put away the disposition in a sealed cover for reasons’ Kumar alleged that Dhoni had filed the case in the Madras High Court with the “sole motive” to gag the IPS officer.
"The 3rd defendant submits that in the Plaint the sole focus was to gag the 3rd Defendant, that's the main reason they chose Madras High Court whereas none of the other three Defendants or the Plaintiff are based in Tamil Nadu. The Choice of Senior Counsels representing the Plaintiff speaks volumes about the conspiracy behind this Plaint," the plea said. He sought further action against Kumar under the law.
